"Service" refers to the residential care, home assessment, comfort care, and related services provided by Lunar Drift. "User" or "you" refers to any person who accesses our website or engages our services. "We", "us", or "our" refers to Lunar Drift, located at 44 Lat Phrao Road, Wang Thonglang, Bangkok 10310, Thailand. "Agreement" refers to these Terms and Conditions together with our Privacy Policy and Cookie Policy. "Content" refers to all text, images, and other materials published on our website.

2. Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services. You must be at least 18 years of age to use our website or enter into a service agreement with us. By agreeing to these terms, you represent that you have the legal capacity to enter into a binding agreement.

3. Service Description

Lunar Drift provides elderly care services including residential wellness programs, home assessment and adaptation consultations, and end-of-life comfort care. Services are available in the Bangkok metropolitan area and surrounding provinces, subject to availability. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice provided to existing clients.

4. User Responsibilities

When using our website, you agree to provide accurate and truthful information in any forms or communications. You agree not to use the website for any unlawful purpose or in any way that could damage, disable, or impair the site's functionality. You are responsible for maintaining the confidentiality of any account credentials if applicable. You agree not to reproduce, distribute, or create derivative works from our website content without our prior written consent.

5. Intellectual Property

All content on this website, including text, graphics, logos, images, and design elements, is the property of Lunar Drift or its licensors and is protected by Thai and international copyright laws. You are granted a limited, non-exclusive licence to access and view the website content for personal, non-commercial purposes. 6. Payment Terms

Service fees are quoted in Thai Baht (฿). Residential care fees are billed monthly in advance. Home assessment fees are payable upon booking confirmation. The specific terms of payment, including due dates and accepted methods, will be outlined in the individual service agreement provided to each client. Late payments may incur a reasonable administrative fee as specified in the service agreement. Refund eligibility depends on the nature of the service and the stage of delivery, and will be assessed on a case-by-case basis. Details are included in each service contract.

7. Service-Specific Terms

Holistic Wellness Residence: Residential placement is subject to an initial assessment and mutual agreement between the family and Lunar Drift. A minimum stay period of one month applies. Termination of the residential agreement requires 30 days' written notice from either party.

Home Assessment & Adaptation: Assessment visits are scheduled by appointment. The resulting report and recommendations are provided for informational purposes and do not constitute a professional engineering or medical assessment. Implementation of recommendations is at the family's discretion and expense.

End-of-Life Comfort Care: This service is provided on a compassionate basis and may be initiated without a minimum commitment period. Families may choose to discontinue the service at any time. Bereavement support is offered at no additional cost.

8. Disclaimers

Our services are provided on an "as is" and "as available" basis. While we strive to deliver the highest quality of care, we do not make representations or warranties of any kind regarding specific health outcomes, recovery timelines, or improvements in the resident's condition. Information on our website is intended for general informational purposes and should not be considered medical advice. We recommend consulting with qualified medical professionals for health-related decisions.

9. Limitation of Liability

To the fullest extent permitted by Thai law, Lunar Drift shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim related to our services shall not exceed the total fees paid by you for the specific service in question during the 12-month period preceding the claim. This limitation does not apply to liability that cannot be excluded or limited under applicable Thai law.

10. Indemnification

You agree to indemnify and hold harmless Lunar Drift, its employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your use of our website, or your violation of any applicable law or third-party rights.

11. Termination

We may suspend or terminate your access to our website at any time if we believe you have violated these Terms. For service agreements, termination provisions are outlined in the specific service contract. Upon termination of a service agreement, any outstanding fees remain due. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — shall continue to apply.

12. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from or relating to these Terms or our services shall first be addressed through good-faith informal negotiation. If a resolution cannot be reached informally within 30 days, disputes shall be submitted to the jurisdiction of the Thai courts located in Bangkok.

13. General Provisions

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Lunar Drift regarding the use of our website and services. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
